These Terms of Service (“Terms”) govern your access to and use of shankzgolf.com, our online services, purchases and bookings made through those services, and visits to Shankz Golf & Arcades (collectively, the “Services”).
By accessing or using any part of the Services, submitting a booking or purchase, or entering our venue, you acknowledge that you have read and agree to be bound by these Terms. No separate checkbox is required for these Terms to apply. If you do not agree, do not use the Services or submit a booking or purchase.
1. Eligibility and Website Use
You must be legally capable of entering into a binding agreement to make a booking or purchase. If you book or purchase on behalf of another person, organization, or group, you represent that you have authority to bind them to the provisions that apply to the booking, purchase, or visit.
You may use the website only for lawful, personal, and non-commercial purposes. You may not misuse the website; attempt to gain unauthorized access; interfere with its operation or security; introduce malicious code; submit false, misleading, or fraudulent information; scrape or copy content through automated means; or use the website in a manner that burdens or damages it.
2. Information, Availability, and Errors
We try to keep hours, prices, packages, menus, promotions, and availability accurate, but information may change without notice or contain errors. To the extent permitted by law, we may correct errors and reject or cancel orders or bookings affected by an error. If we cancel a paid order or booking solely because of our error and cannot provide an agreed substitute, we will refund the amount paid for the unavailable item or service.
3. Party and Event Bookings
- Confirmation. A booking is confirmed only after you receive confirmation from Shankz.
- Deposit. Once an event is booked and its deposit is paid, the deposit is non-refundable. The deposit will be credited toward the final event bill after the event is completed.
- Rescheduling. If you need to reschedule after paying the deposit, we will make reasonable efforts to move the event to an available date within 30 days of the original event date. Rescheduling is subject to availability and does not convert the deposit into a refundable payment.
- Changes. For non-private events, guest-count and food, beverage, or game-card selections may be changed until the event begins, subject to availability. For private events, requested changes must be submitted at least 72 hours before the event and remain subject to availability.
- Private events. A private event is closed to the general public and must be booked through our events coordinator. An event booked through another method is not a private event unless Shankz confirms otherwise in writing.
- Changes by Shankz. If we must cancel or move an event because of a venue closure, safety concern, or circumstance beyond our reasonable control, we will make reasonable efforts to reschedule it to an available date within 30 days. If we cannot do so, we will offer a refund or credit as required by applicable law.
- Group responsibility. The person making the booking is responsible for communicating applicable rules to the group and for damage caused by the group, to the extent permitted by law.
The non-refundable deposit and material booking terms will also be displayed during the booking process before payment or submission. Completing the booking or paying the deposit confirms acceptance of those disclosed terms.
4. Game Cards, Gift Cards, and Promotions
Game cards and gift cards have no cash value except where required by law and will not be replaced if lost or stolen. They expire 10 years after the purchase date, except where applicable law requires otherwise. Promotions and coupons are subject to their stated terms, may not be combined unless expressly allowed, and may be modified or ended at any time, subject to applicable law.
5. Venue Rules and Safety
- Children must be supervised by a parent, legal guardian, or responsible adult at all times.
- Guests must follow posted rules and reasonable staff instructions and must treat equipment, games, employees, and other guests with respect.
- We may refuse service or require a person to leave, without a refund to the extent permitted by law, for behavior that is unsafe, disruptive, abusive, unlawful, or contrary to venue rules.
- Activities at the venue involve ordinary risks, including slips, trips, falls, collisions, and contact with equipment or other guests. Dim lighting, LED-lit curbs, dividers, miniature-golf features, and arcade equipment may create trip or collision hazards. Guests must use reasonable care and supervise minors.
- Outside food and beverages are not allowed unless Shankz agrees otherwise in writing for a private event. Guests attending a public event may bring one customary celebration item, such as a cake, cupcakes, or cookie cake, subject to staff direction and applicable health and safety rules.
Nothing in these Terms waives liability that cannot lawfully be waived.
6. Alcohol Service
Alcohol may be served only to guests age 21 or older who present a valid, unexpired government-issued photo ID. We comply with applicable Texas Alcoholic Beverage Commission requirements. We may refuse or stop alcohol service to any person who appears intoxicated, cannot present acceptable identification, behaves unsafely, or attempts to provide alcohol to a minor. Outside alcohol is prohibited.
At private events, alcohol may be served only by Shankz staff to eligible guests who present valid identification. Service is limited to no more than two drinks per guest per hour. Event hosts may select a drink-ticket or cash-bar format. Last call is 30 minutes before the scheduled end of the event. Shankz may slow, refuse, or discontinue service to any guest at any time.
7. Photography, Recording, and Surveillance
Security cameras operate in and around the venue for safety, security, loss prevention, and incident investigation.
Shankz may also photograph or record venue activities and events for business or promotional use. By entering an area where conspicuous notice of photography or recording is posted and remaining after a reasonable opportunity to notify staff, you acknowledge that incidental images of you may be captured. If you do not want to be featured in promotional content, tell a team member. We will make reasonable efforts to honor the request. A separate release may be requested for planned or featured promotional content when appropriate.
8. Intellectual Property
The website and its text, graphics, logos, photographs, videos, design, software, and other content are owned by or licensed to Shankz and are protected by intellectual-property laws. Except for ordinary personal use of the website, you may not reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit that content without prior written permission. Shankz and its related names, logos, and branding are trademarks or service marks of Shankz or its licensors.
9. Third-Party Services and Links
The Services may link to or rely on third-party services, including booking platforms, payment processors, maps, and social-media platforms. We do not control and are not responsible for their content, availability, security, terms, or privacy practices. Your use of a third-party service may be governed by that provider’s terms and policies.
10. Disclaimer of Warranties
To the fullest extent permitted by law, the website and online Services are provided “as is” and “as available.” Shankz disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the website will always be available, secure, uninterrupted, or error-free.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, Shankz and its owners, affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Services, even if advised that such damages were possible.
To the fullest extent permitted by law, the aggregate liability of Shankz and the foregoing parties for any claim relating to the Services will not exceed the amount you paid Shankz for the product, booking, or service giving rise to the claim. These limitations do not apply to liability that cannot be excluded or limited under applicable law.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Shankz and its owners, affiliates, officers, employees, and agents from claims, liabilities, damages, judgments, losses, and reasonable attorneys’ fees arising from your unlawful or unauthorized use of the Services, your material violation of these Terms, or the conduct of your party or group. This section does not require indemnification for Shankz’s own negligence or misconduct to the extent such indemnification is prohibited by law.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any lawsuit arising out of or relating to these Terms or the Services must be brought in a state or federal court with jurisdiction in Montgomery County, Texas, and each party consents to the personal jurisdiction and venue of those courts. This section does not prevent either party from pursuing a claim in small-claims court when eligible or from exercising a right that cannot lawfully be restricted.
14. Changes to These Terms
We may update these Terms by posting a revised version with a new “Last updated” date. Updated Terms apply prospectively from the date posted. By continuing to use the Services after the updated Terms become effective, you agree to the updated Terms. Material changes to an existing, confirmed booking will not apply retroactively unless you agree or applicable law permits otherwise.
15. Electronic Acceptance
Your access to or use of the Services constitutes acceptance of these Terms. When the booking or checkout page presents a notice that submitting the form, selecting a booking button, or completing payment constitutes agreement to these Terms, taking that action provides additional confirmation of your acceptance. A separate checkbox is not required unless Shankz chooses to use one or applicable law requires affirmative consent for a particular subject.
